3. Third-Party Services and Liability
While HarmENT may collaborate with third-party service providers, including platforms, freelancers, and other collaborators to provide some of its services, such as music production, artist management, Spotify playlist promotion, and music marketing, it is important to note that HarmENT is not responsible for the actions, results, or performance of these third-party providers.
These services are outside the control of HarmENT, and you agree that HarmENT will not be held liable for any damages, losses, or unsatisfactory outcomes that may arise from third-party services.
For example, if you engage in services like ghostwriting services or press releases through third-party collaborators, HarmENT cannot guarantee the quality, timing, or effectiveness of the third-party services. Music producers, public relations experts, or event managers involved in these engagements are not under the direct supervision of HarmENT.
You acknowledge that you engage with these third-party services at your own risk and that HarmENT cannot guarantee the results or quality of work from any third party. As such, any outcomes from third-party services are not guaranteed, and HarmENT will not be held responsible for any dissatisfaction or issues arising from these services.
All third-party engagements are subject to their own terms of service, which you should review carefully.
HarmENT makes every effort to ensure that third-party collaborators align with the quality standards expected in the industry, but we cannot control their performance. By using HarmENT’s services that involve third-party collaboration, you agree to waive any claims against HarmENT for damages, losses, or unsatisfactory results.
Furthermore, all third-party service engagements are subject to the HarmENT Terms of Service, and clients agree to these terms when they engage with HarmENT’s services.
4. Services Involving Confidentiality Agreements
In the case of services such as ghostwriting services, lyric guidance, or any other services that involve confidential creative work, Non-Disclosure Agreements (NDAs) will be required to ensure the confidentiality of the work being provided.
By engaging in these services, you explicitly agree to the terms outlined in the Non-Disclosure Agreement at the point of purchase or before the commencement of work. It is assumed that by proceeding with such services, you are aware of and accept the legal obligations under the NDA, which will be provided to you separately.
Services such as music production or artist management, when involving confidential or proprietary elements, may also require NDAs to protect the sensitive information related to your creative process or business plans. HarmENT takes confidentiality seriously and strives to safeguard both your artistic work and business strategies.
Failure to comply with the terms of the NDA will result in immediate termination of services, and HarmENT reserves the right to pursue legal action in the event of a breach, as outlined in the HarmENT Terms of Service. This includes, but is not limited to, the unauthorized sharing or distribution of any materials, content, or strategies that are considered confidential under the agreement.
Any third-party service providers involved in such services (e.g., music producers or collaborators for music marketing) will also be required to sign confidentiality agreements, and HarmENT ensures that all third-party providers comply with the same level of confidentiality.
However, HarmENT is not responsible for the actions of third-party collaborators in relation to confidentiality, as noted in the HarmENT Terms of Service.
5. Press Releases and Promotional Outcomes
HarmENT offers press release and promotional services, which may include the distribution of press materials to media outlets, influencers, and other relevant contacts. These services may also include Spotify playlist promotion, artist promotion, and efforts to enhance your music marketing strategy.
However, it is important to understand that HarmENT cannot guarantee the success, reach, or impact of these press releases or promotional efforts.
No Guarantee of Results:
We cannot predict the precise outcome of any press efforts, such as the extent of media coverage, the number of press features, or the effect on your career. While we strive to provide the best possible exposure for your music and brand, the success of press campaigns is highly variable and subject to external factors beyond our control.
Liability Disclaimer:
HarmENT does not accept liability for any failure of press releases, media coverage, or promotional efforts to yield immediate or desired results. You agree that the success of press and promotional services, including music distribution, radio promotion, and music production efforts, is not guaranteed, and HarmENT will not be held accountable for any damages, losses, or lack of results that arise from these efforts.
The outcome of press services is entirely at your own risk, and HarmENT is not liable for any perceived lack of success or failures related to press or media campaigns. HarmENT also disclaims any liability for the impact, reach, or results of third-party promotional efforts or services involved in the press campaigns, such as collaborations with music producers, influencers, or PR experts.
All services provided are subject to the HarmENT Terms of Service, which outline the scope and limitations of these promotional efforts.
By engaging in press release and promotional services, you acknowledge and accept the inherent risks involved and agree to the HarmENT Terms of Service.
6. Unique Service Terms
Each service offered by HarmENT, such as music production, artist management, Spotify playlist promotion, or music marketing, may have its own unique set of terms and conditions that govern its use and delivery. These terms are tailored to each specific service to ensure both the client and HarmENT have a clear understanding of expectations, responsibilities, and deliverables.
When you purchase or engage in any service provided by HarmENT, you agree to the terms specific to that service, in addition to these general HarmENT Terms of Service. This ensures that both you and HarmENT are aligned on the service’s objectives, scope, and timelines.
Each service may come with additional clauses or special provisions, such as those related to confidentiality, timelines, payment schedules, intellectual property rights, or any third-party collaborations. For example, if you engage with ghostwriting services or lyric guidance, you may be required to sign an additional Non-Disclosure Agreement (NDA) to protect the confidentiality of the work.
Similarly, services like press release distribution or radio promotion may include terms regarding the media contacts, outreach strategies, and reporting methods.
Upon engagement, HarmENT will provide you with these specific terms for your review. You acknowledge that you have been made aware of, and have agreed to, the terms related to the specific service you are receiving. These terms will be presented to you before the commencement of any work, and you will be asked to acknowledge your understanding and acceptance.
Custom Services and Third-Party Collaborations:
In some cases, HarmENT may collaborate with third-party providers such as music producers, public relations experts, or event managers to deliver certain services. In these situations, you agree to abide by the terms set forth by the third-party collaborators as well, and HarmENT will ensure these terms align with the general terms of engagement.
However, HarmENT will not be held liable for any issues that arise from third-party collaborations, as noted in the HarmENT Terms of Service.
For services such as music distribution, Spotify playlist promotion, or radio promotion, the terms may also include aspects such as delivery timelines, reporting protocols, and payment schedules that are essential for tracking the progress of the campaigns. HarmENT Terms of Service are designed to ensure transparency and a smooth workflow between you and HarmENT, and you are expected to adhere to these terms to avoid any misunderstandings or disputes.
Updates and Modifications:
HarmENT reserves the right to modify, update, or discontinue certain services at its discretion. If significant changes are made to the terms of a specific service, HarmENT will notify clients of these changes in writing. You agree to review these updates and continue engaging with the services only if you accept the new terms.
Any modifications will be clearly communicated through the appropriate channels, and by continuing to use the service, you acknowledge and accept these changes.
In summary, you acknowledge that by purchasing or engaging in any service provided by HarmENT, you are entering into an agreement that is governed by both the HarmENT Terms of Service and the unique terms specific to the individual service. HarmENT is committed to ensuring that these terms are clear, fair, and tailored to suit the unique requirements of each service offering.

This includes, but is not limited to, financial losses, damage to HarmENT’s reputation, and any other costs that may arise from the breach of our policy.
